The agreement
DAYS is licensed, not sold, to you. By downloading or using it you accept these terms and Apple’s Licensed Application End User License Agreement, which applies to every app distributed through the App Store and is available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these terms and Apple’s EULA disagree, Apple’s EULA governs.
If you do not accept these terms, delete the app.
What you may do
You get a personal, non-exclusive, non-transferable licence to use DAYS on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may use it for anything lawful, personal or commercial.
What you may not do
Do not copy, sell, rent, sub-licence or redistribute the app; reverse-engineer, decompile or disassemble it except to the extent that law expressly permits despite this restriction; remove or alter any notice of ownership in it; or use it in a way that breaks the law or interferes with anyone else’s use of their device.
Your content is yours
The countdowns, notes, journal entries and photographs you put into DAYS belong to you. They are stored on your iPhone. The developer does not receive them, cannot access them, and claims no rights over them. See the Privacy Policy for exactly where they live and what leaves the device.
Because your content stays on your device, you are responsible for keeping a backup of it. The app has no copy and no way to restore anything. If you delete the app, erase your data within it, reset your iPhone, or lose the device without a backup, that content is gone and cannot be recovered by anyone, including the developer.
Reminders are a convenience, not a guarantee
Reminders are local notifications scheduled by iOS. Whether and when one arrives depends on your notification settings, Focus modes, Low Power Mode, available storage, how iOS chooses to schedule work, and how many pending notifications exist — iOS holds a limited number per app.
Do not rely on DAYS for anything where a missed reminder matters: medication, legal deadlines, flights, appointments, or anything involving safety or money. DAYS is a way to look forward to things, not a system of record.
Price and purchases
Any purchase of DAYS is made through Apple, not through the developer. Apple’s App Store Terms of Service govern payment, receipts, family sharing and refunds. Refund requests go to Apple at reportaproblem.apple.com; the developer cannot issue refunds and does not see your payment details.
If DAYS is a paid app, a single purchase covers the Apple Account that bought it, on the devices that Account is signed in to, under Apple’s usual terms, and includes future updates to the app at no further charge unless a future version is published as a separate app. The price may change for new purchasers at any time; this does not entitle anyone to a refund or a payment.
DAYS contains no advertising, no subscription and no in-app purchases. If that ever changes, it will be stated on the App Store page before you buy.
Updates
Updates may be released at any time, and may add, change or remove features. When DAYS opens it checks whether a newer version exists. In the rare case that a released version is found to put your data at risk, that check can require you to update before continuing to use the app; the app will say which version it needs and why, and your countdowns remain on your phone throughout. See the Privacy Policy for what that check sends, which is nothing about you.
No warranty
DAYS is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by law. The developer does not warrant that the app will be uninterrupted, error-free, or that any defect will be corrected.
Limitation of liability
To the fullest extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or relating to your use of or inability to use DAYS, even if advised of the possibility. Where liability cannot lawfully be excluded, it is limited to the amount you paid for the app, or to ten US dollars, whichever is greater.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Your statutory rights
If you are a consumer, you have rights under the law of your country that these terms do not affect. Nothing here takes away a right you have by law, and where these terms conflict with a mandatory consumer protection in your jurisdiction, that protection applies.
Apple’s role
Apple is not a party to these terms and has no obligation to provide support for DAYS. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Any claim that the app fails to conform to a warranty may be directed to Apple, which may refund the purchase price; beyond that, Apple has no warranty obligation. Apple is not responsible for addressing any claim about the app, including product liability, legal compliance, or intellectual property claims.
You confirm that you are not located in a country subject to a US Government embargo or designated as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties.
Ending the licence
The licence lasts until it ends. It ends when you delete the app, or if you break these terms. On ending, you must stop using DAYS and delete it. The sections on your content, warranty, liability and Apple’s role survive.
Changes to these terms
These terms may be updated when the app changes. The effective date above shows when they were last revised. Continuing to use DAYS after a change means accepting the revised terms; if you do not accept them, delete the app.
Governing law
These terms are governed by the laws of the jurisdiction in which the developer resides, without regard to its conflict-of-law rules, except where the mandatory consumer law of your own country of residence applies instead.
